What Did the Island-Wide Register Sweep Find? #
Officials at the Land Department checked all 1,832 land-holding companies on Koh Pha Ngan and found 112 with foreign shareholding above the Land Code limit.12 Not a raid on a tip. The whole register.
The 112 split in two: 104 identified fresh through inspection, 8 already subject to court rulings.1 Together they hold 124 plots, roughly 86.86 rai.12 The earlier 14 August figure of 104 companies sits inside today's 112: that was the inspection cohort, never the full count.
Every one of the 112 sits at one of three stages: 8 ordered to sell, 28 pending a decision, 76 being compiled at the branch land office.12 Nothing has been dropped.
For scale, Land Department director Pornpoj Penpart said in May 2026 that foreigners legally own only six per cent of land on the island.3
How Does a Governor's Disposal Order Actually Work? #
This runs through the Land Code's limit on foreign shareholding, not a Foreign Business Act prosecution. A provincial governor administers it directly, once a Department of Business Development register filed with the Ministry of Commerce fails the test.
An FBA case needs a prosecutor and a court. A governor's order just needs a failed register, so it moves faster and reaches the asset directly, with no case against any named person required. It runs alongside, not through, the source-of-funds checks AMLO applies to high-risk sectors.4
What Would Change Under the Proposed Forfeiture Amendment? #
Today, a forced disposal costs the holder the land but returns the sale proceeds. A Land Code amendment under study would replace that with forfeiture to the State, returning nothing. Unenacted; direction, not deadline, but it changes what waiting costs.
What Does This Mean for Existing Owners on Koh Pha Ngan? #
Anyone already running an at-risk property-owning company on the island should read these numbers as a countdown, not a curiosity. The exposure now sits with the land itself, on a timetable the owner does not set; a disposal order is a forced sale, not a considered exit.
A planned divestment runs eight to sixteen weeks, short against a queue already holding 76 companies.
