What Has Actually Been Established So Far? #


How Did a Cemetery Become a Company Examination? #

An inspection of an unlicensed cemetery in Bang Khla district, Chachoengsao, traced the land to Gan Chabad Co., Ltd.56 Interior is coordinating with the Ministry of Commerce, the DSI and the Anti-Money Laundering Office on whether the company and linked firms were lawfully established.5

Three shareholders were born in Israel and hold Thai citizenship, which is precisely what makes the examination legally difficult.56 The DSI has issued subpoenas; no charge has followed.6 One outlet alone reports links to at least 25 other companies, a scale nothing else corroborates.5

What Happened in Phuket? #

Phuket's governor inspected Chabad House Patong on 15 September under an Interior Ministry order.7 A municipal order dated 1 September had already found construction departing from approved plans, stopped use of the non-compliant areas and allowed 30 days to rectify, under the Building Control Act.2

On 20 September customs officers temporarily seized the shop goods pending import documentation, and the provincial land office attended on land ownership and acquisition.3 Officials separately reported goods lacking the Thai-language labels required by law, a Food and Drug Administration matter, separate from the customs check.3 Bangkok Post reports five agencies ordered to examine two affiliated companies, including whether unlawful shareholding exists and whether those shareholders overlap with the cemetery company.4

A THB 261.58 million total has been reported for two Choeng Thale companies, called combined assets by one outlet and a stated business value by another, and neither is registered capital held at the Department of Business Development.82

What Did the Minister Add on 22 September? #

The Deputy Interior Minister set out the national picture on 22 September: eight or nine sites under examination, Phuket permit irregularities carrying 30 days to regularise or face demolition, unlabelled goods being prepared for seizure, and checks in Krabi and Bangkok.1

At Phra Athit Road in Bangkok, no underground construction was found, contradicting earlier reports.1 And the figure of nearly THB 100 million is not a finding: MPs gave the minister an estimate for land bought in the three southern border provinces, and he said he intends to establish who owns it.1

Why Thai Citizenship Does Not Settle the Question #

Section 36 of the Foreign Business Act asks whether a Thai person holds shares for the benefit of a foreigner. It does not ask where the shareholder was born. A naturalised Thai citizen is a Thai national in law, so citizenship answers a question the statute never poses. That is why such an examination is slow.

Where a nominee structure is established, section 36 reaches nominee and foreign beneficiary alike: up to three years' imprisonment, a fine, cessation of the shareholding and forced disposal of the land through the Department of Lands. No such finding exists here.

What Owners Should Take From the Sequence #

What matters here is what opens the file. None of this began with a land complaint; it began with a cemetery licence, a building permit and a customs form. Once several agencies attend together, the shareholder register is read beside the permit file, and a high-risk property-owning company has two exposures at once. Divestment runs eight to sixteen weeks, and is best begun before an inspection brings several agencies to the door.
